Advice needed
AnsweredI have recently bought an expensive item which although described by the seller as mint condition and fully working is actually faulty. I have emailed seller twice with no reply, so informed the seller via another listing of theirs that I have sent emails which I feel must have gone to junk folder. I received a very strange reply to that and now feel very concerned. I dont want to do anything out of step moving forward with this and wonder if a moderator could help me with this please.

Sorry to read you have concern over your recent trade,
Faulty goods are supported by TradeMe and are the Seller's responsibility to rectify for you, seller options include to repair, replace or refund. - If you're not receiving expected assistance from your seller and within a reasonable time of alerting them to this file a dispute report for assistance from a staff member. Ensure you've provided your seller with photo's of the fault, where applicable and able take a video of the fault in action, continue to communicate with your seller towards a resolve. All email correspondence, item fault photo's and video's are beneficial to upload in your dispute report if your seller isn't addressing the issue or playing fair. - If the fault has been caused during shipping your seller is responsible for assisting you direct in the first instance, they would make their own claim through the carrier company, in this case you will want to provide the seller with any damaged packaging to help them support their claim. - All the Best.

thank you, I have filed a report. I was only able to upload 1 of the 3 screenshots regarding this so I am not sure if that is adequate. I do have of course the emails and screenshot from my question on the sellers other listing. This is very concerning and certainly does not match sellers TM history which leaves me at a total loss s to why this is happening. Thanks again for your reply and support.

If you go through 'My Requests' top right of community pages and click into the subject line of your report you should be able to upload further screenshots and information there. - I would be inclined to add a note stipulating the response you've received appears very uncharacteristic of the seller's TM feedback history which is of concern, pointing staff to take a closer look into the account. - Cheers.

Thank you to all of you for all of your replies. This really is concerning and strange, I would detail the situation gladly here but I'm sure that would not be correct. I have been with TM quite a few years and both bought and sold many differing things, many in the several thousand dollar range and had a few niggles with some but not like this. Just so glad I still have packaging ( which was so so well done) and all that there is re emails screen shots etc.

Hi again all, long story short - the seller has decided to honour a refund on this item ( albeit claiming it was tested and nothing was noticed ) however he is suggesting I send it back for a full refund. I admit not actually knowing the protocol on this, I used Ping to pay if that has any bearing on it, but should I ask for the refund first? or am I in some way bound to send the item first? The way I see it, money is always first. Does anyone know if there is a rule on this, or what course I should/can take? I appreciate any input thank you.

Hi, yes generally you would send it back first. This gives the seller the opportunity to inspect and confirm the faults. They are required to refund you the return shipping costs too, so make sure you keep the receipt for that and let them know the amount.

Thanks AJ, I had a feeling that would be so, but I just wondered if there was actually a rule. I have emailed the seller with an understanding style letter asking for refund to be made to my account and then I will send it back in the original packaging free of charge. I am uncomfortable in this case to be without both the purchase money and the product, $2000 is too much for me to do this. I do feel that " English not being native tongue" has played a role in creating integrity concerns for me but even after saying that there are a couple of clear statements from the seller that dont add up and dont reflect what I would consider as normal response when I put myself in his shoes if I was genuinely oblivious to any issues with my product, it's enough for me to take the course chosen. I know he has been contacted by TM and will be aware they are re-contacting me in 6 days for update so hopefully he will put the same trust in me as I did with him. Thanks for your response.

Great to read your Seller has agreed to a refund,The policy expects that if an item needs return shipping (including faulty/not as described), it should be returned to the seller and refunds under Buyer Protection are processed after the seller receives the item.As your item purchased value is substantial sending it by signature required courier with a recognised shipping carrier is advised. This is applicable to all purchases over $250.As this purchase is under a dispute TradeMe can assist with a credit of reasonable shipping costs upto the value of $50. if the seller isn't agreeable to refund the return shipping upfront. This cost is normally passed on to the seller as well as your original shipping cost paid if the seller doesn't cover you directly for either - Cheers.0
