Who makes a claim against the courier - buyer or seller?
AnsweredI shipped something via courier (via TradeMe book-a-courier service as it happens). It was sent "signature required" and the courier didn't get a signature and the package was (assumedly) stolen. It was marked as "contactless signature".
Do I refund the buyer and make a claim against the courier company?
Or does the buyer make a claim against the courier company?
I feel that once the courier picked up the signature-required package that that was the demarcation point of the sale and the buyer should make the claim against the courier company as I had done all I could have done already.

The seller needs to follow it up and make the claim,
as the seller is the one whom has formed a Contract with the carrier when you use their service,
The seller is also the one that knows how it was packaged, size etc,
The Courier Company will refund the seller where appropriate, then seller will refund the buyer,

Whoever made the booking is the one that is responsible for chasing them up, in this case it would be the seller.

The person who made the booking has the contract with the courier so they are responsible for following up and if need refunding. However before refunding you need to ensure courier accepts liability. If it was signature required but signed as contactless signature, it means that courier has knocked on the door, when opened they ask name of receiver, courier then signs that name and leaves parcel 2 meters away. It does not mean courier had no contact at door to just left it anyway and did a "false signature". If it was signed for infront of receiver, how can it be stolen? Sometimes courier company will have GPS tracking of where driver went to, maybe it was the wrong house

If it was signature required, but was not delivered as per signature required conditions, then its deemed not delivered. So its a courier issue for the courier to sort out

I am the seller, and used Aramex to deliver to Wellington, but never got there, now they are saying the parcel is lost or damaged, and for me to fill out at least 3 pages for Insurance, has anyone else gone through this please, its doing my head in

Yes, it's quite a lot of paperwork to do when something goes missing, no matter what courier you use. It's not really worthwhile for lower cost items where they only reimburse the cost price rather than the sell price.

If the seller sent the parcel but the courier did not deliver the parcel and stated that it was now damaged, surely it is up to buyer of the parcel to make a claim with the Courier for not delivering ?

AS above the buyer actually paid for the Courier so should make the claim ?

James, the seller is the one that paid the courier to deliver it so it's the seller that makes the claim. The seller refunds the buyer as they did not get what they paid for and the seller then claims back from the courier.
Oh, I see you just posted again saying the buyer arranged the courier, so if it was adequately packed then yes, the buyer needs to make the claim.

It is the sellers responsibility to make the claims generally,
It is the seller whom has form a contract with the carrier they have used,
either by booking online, or using their services via Post shop etc. which seller has physically paid for, after buyer has paid them,
The seller then has organized the shipping with their preferred carrier,
But if the Buyer arranged the Courier as you say, it is then the buyers responsibility to make the claim, as they have contracted the courier to do a job for them, taking it out of the sellers hands,

AT last ! After having large verbals with Aramex they admitted after 5 days that only the packaging was damaged not the contents. They will now deliver.
