SELLER STILL AWAITING PICK-UP 5 WEEKS ON
I have fairly recently sold an old medium-sized wooden workshop cabinet. The buyer asked me if I was happy to hold onto it until they arranged collection. I promptly informed them that I would be happy to hold for a fortnight, if payment was made within a week of the auction closing. Payment was swiftly made via Ping but I'm now one day shy of 5 weeks on, as the auction closed on Wed 10th June and it's now Tues 14th July. Dispute good naturedly twice reminding them politely via e-mails and subsequent assurances of collection, it has still not been picked up. & how I am then placed if they now turn around & ask for a refund due to not being able to arrange collection or continue to expect me to hold onto the item indefinitely? https://www.trademe.co.nz/a/marketplace/antiques-collectables/furniture-woodenware/furniture/1900-1949/listing/5968157116

If this item is not collected by <<<insert time/date of your choice here>>> storage fees will be charged at $20 per day. If the item is still not collected after all your funds have been used in storage fees the trade will be considered abandoned, and the item will be disposed of.
I've threatened this before for tardy buyers. Legally it might not be something you can actually do, but it usually gets them moving...........

Kia Ora marriott76,
Sorry to read you're in Limbo with that Trade,
Do you know why there has been such a lengthy delay in pick up? - The recent weather flooding parts of the South Island and road closures may be a real factor worth taking into consideration therefore if you can obtain a certain date of pick up this would be ideal Otherwise you are best to email back stating if the item isn't picked up by (date of your choosing) you will have to cancel the Trade & relist the item as it is well surpassed the agreed contract timeframe, weather events taken into consideration. - Yes! you will have to refund in full, any Ping fee charged to you will be automatically refunded back. - By law storage fees can only be applied to large items consuming considerable space.
Unfortunately natural disasters are unpredictable and may effect the efficiency of completing Trades by either or both the Seller & Buyer's initial agreements, communication is key and your Buyer is in contact with you. - All the Best.
You're hardcase Callum :)

Their contact/partner is in the South Island on a trip of some nature and is going to collect it & take it back with them to Wellington. They have my phone number & address but I am still awaiting a call. It appears as though I am no longer going to be given any specific date, just whenever it suits them. I have already e-mailed them twice good naturedly hurrying them along, enough is enough. How long does Ping cover being mucked around for, surely there's a finite time? As I'm sure that you couldn't get a refund on a damaged item after a certain period of time has elapsed?

You need to get strict marriott76
You said you would give them a fortnight. That has passed. Why are you still allowing them to string you along? If you give an ultimatum, stick to it. Give them a further 48 hour deadline if you must, then cancel the sale if they still haven't collected it.
Ping Buyer Protection is 30 days. You are getting close to the 45 day limit for feedback as well. Post some positive or neutral now explaining the buyer hasn't yet collected, and change it to negative later if needed.

They aren't getting a refund, is that strict enough for you?

Kia Ora marriott76,
As you agreed in the Q&A section to hold the goods for a fortnight for the Buyer that is the contract formed - As that fortnight is well surpassed you can cancel the Trade, this is usually in agreement with your Buyer, then you can relist the item. - To cancel a Trade you must refund the Buyer, to refuse a refund is theft and your Buyer can put a claim through appropriate departments. - You can't relist the item before refunding the Buyer as you are no longer the owner of the item, your Buyer is regardless of non pick up. - Your best option is to cancel the Trade due to non collection within the agreed contract timeframe, refund your Buyer, place appropriate feedback and relist your item . - End of Trade & potential legal proceedings.
Code of Conduct: - Comply with all laws, including sale of goods and intellectual property laws.
TradeMe site T&C's: - Keep it legal: You'll comply with all applicable laws when using our Services.
Buyer Protection is covered for 30 days - Legal proceedings are covered from the onset of occurrence and impact Members TradeMe accounts pending review and outcome.

I've expended sufficient energy in jollying the buyer along & will not be chasing them up any further. I have found that leaving negative feedback is a waste of time unless you enjoy receiving subsequent retaliatory bad feedback & the time & efforts that go with attempting to tidy that up.

Kia ora marriot76, if it is outside the timeframe agreed with the buyer to collect, and the trade is not complete, and you have made reasonable efforts to complete it, you can cancel the trade by emailing the member to let them know, refunding them in full and relisting the item.

There's the not inconsiderable matter of myself having been stuck with an item that I could have sold a month ago.

I think you should have been firmer in the first place marriott76.
You said you gave them a fortnight, but then really it was you who let that drift to 5 weeks.
You could have cancelled the trade and relisted immediately after that initial agreed time was up.
