Reselling vs Copyright?
just curious for peoples help on this
on one side trademe says you can repair and resell things, on the other they flag some resales as "breaching IP"
like i bought some broken transformers toys, added some spare parts on them to make them complete, and tried to resell but cant because of IP somehow
i declared in the listing it was a repaired toy, i didnt claim it as my own creation, didnt modify any brand or logo, just a repaired toy made up to be a proxy wargaming figure
anyone able to help me get a better understanding whats allowed to be bought/resold on trademe

Kia ora ladymidnight88, thanks for reaching out. Regardless of how you describe the toys, if they are a copy of something else or you are making them up to be something that they are not, then you won't be allowed to sell them as they potentially infringe intellectual property rights.

Sounds a bit odd to me. I mean sure if you're taking a transformers part or logo, then slapping it on another toy and calling it a transformer you might run into trouble. Or you're adding a bunch of non transformer parts to repair it. But as long as the parts you are replacing are also transformer parts you should be fine I would have thought.
Usually there is a reply to possibility when Trade Me withdraw an item and email you? Sometimes they will err on the side of caution if someone reports something. So you could reply and ask for clarification.

just im in business for selling warhammer and related products, and the warhammer community is known for making custom figures using parts from a mix of ranges
i just wanted to reach out to that part of the warhammer community making unique figures for gamers, because many dont have the time, finances or parts to build random things
ive had one such item removed, purely because an individual personally didnt want to see them in his feed when looking for warhammer
would it be best for me to refrain from outside ranges and just make conversions using purely warhammer parts?0 -
