Right to Sell - Shared Property in Dispute Following Relationship Breakup
AnsweredWhat can we do about an ex-partner who starts selling items they are not entitled to sell because they are part of shared property that is in dispute and hasn't been settled by agreement?
It's clear that a person is not allowed to sell stolen property or items they don't have. But when a person lists property that is shared and the other person hasn't had the opportunity to discuss and agree on whether to sell, reserve price, selling price and disbursement of proceeds, how is that any different from allowing someone to sell stolen property?!??
It appears that TradeMe terms and conditions or policies don't actually address this particular scenario, yet allowing a sale without agreement by the other person could potentially result in financial disadvantage or loss for the other person.
Shouldn't we be looking out for the rights of others in a relationship breakup? How would you feel if someone sold something that belonged to you or that you had a share in, potentially at an unreasonably low price, and then kept all the money??

If you see something listed that does not belong to the person selling it, report it to Trademe using the Community Watch button on the listing. There is also an email link on auctions so you can email yourself a copy and then you can collate and forward to the lawyer acting for you in the relationship property settlement case. They can then send a letter to the other party's lawyer with an order to stop it till written agreement is settled.

Thank you - that will work as long as my lawyer can act before the current auctions close!
In the meantime, I have set to be notified of every new listing and have been saving those emails. I guess it won't stop him from selling things or bring back those he has already sold, but it will at least go some way toward ensuring he can't just flog them off and pocket the money!
I did report the most recent listings - still not easy, because there isn't a relevant option, and it's not clear that there's an actual human reviewing those reports and doing anything about them.

S I would use the Live Chat option to contact Trade Me Customer Support and let them know the situation and get their advice. Go to the Contact Us link at the bottom of any page and click on it hover over the bottom right side until a blue Chat bubble appears and you will be able to chat with someone from Trade Me live.
