Getting unwanted sales emails from seller
A member I purchased some items from quite a long time ago has repeatedly sent me promotional emails outside of Trade Me about their listings over quite a substantial period of time, usually when they have discounted items listed that they want to promote sales on. Obviously they retained my email contact details to use for this purpose, and probably do so with their other buyers email addresses as well. I'm sure I won't be the only one receiving them as it's a generic type email. I don't want their promotional emails about their Trade Me listings nor did I agree to, or ask for them to send them to me. Are they breaching T's & C's ?

More importantly they are breaching NZ Law, rather than TM T & C. Check out unsolicited emails NZ Law on the web for details on the law and what to do, other than the usual, click an unsubscribe link if provided, tell your email client to mark as spam, email the seller in question and remind them of the law, etc etc

As long as they have a way to unsubscribe from the emails it wouldn't be seen as a breach (in law)
If there was no easy way to stop them, or you've asked and that wasn't actioned, then that would certainly not be allowed. In either Trade Me's T&Cs or the Unsolicited Electronic Messages Act 2007

Callum, Just to be clear, I did not at any point "subscribe" or agree to promotional emails from the seller. The emails don't relate to any particular item that I purchased from them a long time ago (it's been over 2 years at least) nor does it relate to that particular purchase transaction. There is always a direct link to their Trade Me listings included in the promotional emails that I receive from them. I have asked them in the past not to send me the emails but they still continue.

I reckon they'll do hard labour &/or be forced to accept Ping as a method of payment.
