Sellers responsibility to pay return and outward shipping on returned faulty item.
AnsweredThis is actually for a friend who made an online purchace (not on TM) of a large item which is an unusable item (a serious fault that will be on all the production run of this item) on arrival and needs to be returned. The item is large and will cost a lot of shipping. I believe the seller is responsible for paying shipping both ways however I am trying to find the appropriate legislation that says so. This I believe was in a recent (5-6 years ago)update on online trading legislation but I cannot now find. I believe it was even in the TM help section at one time but appears have disappeared in the recent times. Can anyone offer a pointed to it either on TM or another online source?

Yes Consumer Guarantees Act. Section 18 from memory. Basically you must not be left out of pocket if you purchased a faulty item. Seller has to pay all costs, including the return shipping. Many websites state it. Consumer.org.nz, citizens advice etc.
To make it even more juicy, something that not many are aware of. If that faulty item also caused other damage, the seller is up for that cost as well. (Think a washing machine that failed and flooded the house or similar.)

If the buyer dosen't receive item won from trade me and its lost with couriers as tracking says its been picked up from seller but no movement what so ever for the last 8days. And buyer would like a full refund plus postage amount paid on top but seller only pays the auction amount buyer won it for but not the shipping.. whos in wrong

The seller is in the wrong. If you buy something and you don't receive it, you are due to be refunded 100% of what you paid, including shipping.

Gary is correct. However I would wait a bit longer yet before demanding a refund. Unless the courier company or the seller has confirmed the item as lost. 8 days is certainly not unheard of in the climate we find ourselves in. There are struggles right across the courier network with staffing issues at present.

Hi Brett, you are not allowed to put other members names up on the community board like this.
For your issue the best thing to do would be to open a dispute with Trade Me
In the meantime you might want to edit your post and remove the sellers name.
