Not a professional seller but got an email from trade me re complying with toy safety standards
From time to time I sell dolls in my collection to other collectors through Trade Me. I am not "in-trade" or a professional seller, but today I was sent an email from Trade me :
This is a friendly reminder that it is your responsibility to ensure that your listing complies with applicable product safety regulations. It is important that any items you list are safe and legal to sell.
What does this mean for you?
You must ensure that all children’s toys advertised or supplied in New Zealand comply with AS/NZS ISO 8124.1:2002 Safety of toys – Part 1: Safety aspects related to mechanical and physical properties. You must also ensure your children’s toys do not fall under the Unsafe Goods (Lead in Children’s Toys) Indefinite Prohibition Notice 2009.
Compliance with the Standard and the Unsafe Goods Notice is required by law and reduces the risk of death or injury. We encourage you to read them to ensure your item complies.
All fine and good but the Standard also states:
Who do the rules apply to?
If you are in trade and supply, offer to supply or advertise to supply new or second-hand toys, you must comply with the product safety standard.
The rules do not apply to private sellers of second-hand toys.
Does this mean trade me now consider me a professional/in-trade seller? Of course the email is from an unmonitored address so there's no way to reply...

I'm not TradeMe staff though I can confirm you haven't had the In-Trade badge attached to your account. - There has been a series of email reminders sent out which looks to be for just the Toys category at this stage. Why you have received the email as a casual seller I can't say though suspect there is perhaps a glitch or incorrect setting in the mailout process there unless this has extended to include all Sellers & the email wording hasn't been updated. - Cheers.

Today I had clarification from Trade Me - while the standard (AS/NZS ISO 8124.1:2002 Safety of toys – Part 1: Safety aspects related to mechanical and physical properties) states the standard does not apply to private sellers of secondhand goods (ie items you own that you did not purchase for resale), it is Trade Me policy that all sellers comply with the standard. It's probably worth noting that this particular standard applies to toys for children up to and including 36 months old.

Thanks so much for coming back with that update - this being the case TradeMe need to word the email they're sending out clearly so Members know it's a TM standard reminder for all Sellers rather than causing the confusion they've created by omitting that. - Not very professional of the company and 'it's probably worth them knowing' Members Listing in the older age section eg. 8yrs + have received this email also! - Not a nice response you've received with No apology either! - Cheers.

Sorry, the post above is my words, not a quote from the email. This is what I received after emailing "The Standard itself states specifically that it is NOT an obligation of private sellers. So you are saying it's a Trade Me policy or condition of using the platform, that all sellers meet the standard whether they are legally required to or not."
Trade Me replied "Product safety emails are sent to all members (In Trade or not) who are selling items which could be deemed unsafe. These emails are reminders to check the safety of your items and that they comply with the regulations.
Everyone needs to comply with these rules, even if you're not a professional seller - this is just to keep everyone safe.
If you believe your items already meet the regulations, you're welcome to ignore the email(s)."They are still not directly stating Yes, it's Trade Me policy but that's my best interpretation of the reply.

It would be more professional for TradeMe to state in their first email out to Members that they are including a reminder for both Casual & In-Trade Sellers to check the safety protocols - their response to you in the " " could and should be inserted in the opening paragraphs to avoid the confusion this has caused several Members. - You can set your email client filters to delete these ones on arrival or have them sent to a new folder for your quick view coming forward so your inbox isn't cluttered with spam. - Cheers.
