Check our policies before adding anything to Dealerbase or Trade Me. If your listing doesn't follow our rules, we may need to change, delete, or limit it. We might also have to suspend your access to our website.

These policies are in addition to our general Listing Policies and terms that apply across all of Trade Me.
Image Guidelines
First three photos
- Your first three photos must show the vehicle for sale.
- We recommend using a large, clear image of the vehicle.
Images of other vehicles
- No stock photos – except for new or demonstrator cars, with the consent of the rights holder.
- No images of vehicles other than the vehicle for sale.
Overlays, branding, and messages
- Overlays, text, images, watermarks, photo borders or other enhancements can't be used to promote additional information, offers or messages.
- If you're in-trade and want to advertise your dealership brand, contact your account manager.
- MTA Approved
- AA Approved
- AA Preferred Dealer
- VINZ Approved
- VTNZ Approved
- In transit
To use one of these logos:
- Get requisite approval from the logo owner (e.g. having VTNZ approval to use the VTNZ Approved logo).
- Use the approved logo files provided by us – get in touch.
- The logo must be placed on the bottom-left corner of the image.
- The logo can't be larger than 57 x 45 px.
- These guidelines are also available to Dealerbase users and will be shared with relevant VMS providers
Contact details
Images and listing descriptions can't include:
- Phone numbers.
- Dealership addresses.
- Websites.
- Any other contact details.
Non-vehicle images
Up to two non-vehicle images may be used, of:
- Your dealership brand
- Dealership yard
- Report about the vehicle (e.g. MotorWeb VIR, AA report, CIN).
Non-vehicle images can't be used to advertise or promote finance or other offers. Images of the actual vehicle for sale must also be used. Non-vehicle images cannot be used in your first three photos (see above).
Use as intended, and keep it onsite
Listings aren't for general advertising
- Listings must be used for the sale or promotion of an actual or specific vehicle that is for sale.
- Listings can't be used solely for the general advertising of your brand, business or dealership.
- You must not use a Trade Me Motors listing to promote a business or website.
- If you wish to use Trade Me purely for advertising, check out our advertising service.
Sale of a specific vehicle
- Listings must promote a specific vehicle and shouldn't be used for multiple or generic vehicles.
- You may not use a listing to offer to sell additional vehicles outside of Trade Me or list a per-vehicle price (e.g. if you have two of the same motorbike for sale that you want to promote through Trade Me, you must create two separate listings).
One listing per vehicle
- Don't create multiple listings for a single vehicle.
URLs
- URLs or website links may not be used in listing descriptions.
- If you want to include a link to your website, ask your account manager about our Sitelink product.
Relisting
- Listings can't be reused or edited to advertise a different vehicle.
- The relist function may not be used to manipulate search results, or artificially improve the search position of a listing.
- There are also additional specific terms for relisting Motors listings, depending on the vehicle and listing type (e.g. classified or auction).
Withdrawing auctions
- Listing a vehicle by auction is a commitment to sell it through Trade Me.
- Auctions may not be withdrawn because it hasn't reached the price you wanted – consider setting a reserve price.
- If you don't want to commit to the auction process, consider using a classified listing.
Keyword spamming
- Listing descriptions may not use excessive or irrelevant keywords.
- Keywords must be relevant to the specific vehicle for sale.
- We may remove listings that appear to attempt to manipulate search results.
In-trade sellers
Consumer Guarantees Act (CGA) 1993
- The CGA sets out quality guarantees that any business or person in-trade must provide to their customers.
- You cannot contract out of these guarantees if you're in-trade, and selling to a consumer (someone who's not in-trade).
Listing descriptions can't attempt to contract out of the CGA, where the buyer is a consumer.
Don't:
- Imply the buyer will not have the benefit of protection under the CGA.
- Claim that a vehicle is being sold 'as-is, where-is'.
- State that you're selling on behalf of a private seller.
We'll remove any listings that breach these requirements.
Selling to another business or person in-trade
When selling to another business or person in-trade, you can contract out of CGA guarantees if there's an agreement, in writing, between both parties.
If you intend to contract out of the CGA when selling to another in-trade person you must make it clear in your description that:
- you intend to do so
- this only applies to buyers who are a business, or in-trade
- any claims of contracting out of the CGA do not and will not apply to consumers.
If your listing description isn't clear that any terms intended to contract out of the CGA apply to in-trade and business buyers only, we may amend, remove, or deprioritise your listing.
Registered motor vehicle traders
If you sell six or more vehicles in a year, you're likely to be required by law to register as a registered motor vehicle trader (RMVT).
If so, you must register and state your RMVT number in your listings. You authorise us to search the Motor Vehicle Traders Register on your behalf to check your RMVT status.
Offshore vehicles
You may only sell a vehicle that is offshore if you are a registered vehicle trader.
If you're a registered vehicle trader and want to sell an offshore vehicle, you must:
- Hold clear authority to sell the vehicle.
- Ensure it is intended for imminent transit to NZ.
- Indicate in the listing that such vehicles are offshore or in transit.
You may sell an offshore boat, however you will need to be clear in the listing description that the boat is located offshore and additional costs to ship the boat to NZ may apply.
Consumer Information Notice (CIN)
- Motor vehicle traders must display a CIN when selling a car online via auction.
- The CIN must be in a prominent position on the listing and be provided to the successful buyer.
Pre Order
To list new vehicles for pre-order, you must:
- Have express authority from the manufacturer.
- Be clear in your listing that the vehicle is available for pre-order only.
- Have authority from the rights holder, if using stock photos.
'New' vehicles are brand new vehicles that:
- Haven't been manufactured or driven.
- Haven't yet been shipped to NZ.
Security interests
Anyone selling cars on Trade Me is required to ensure that the buyer of the motor vehicle takes the motor vehicle free of any security interest.
Any security interest on the vehicle must be disclosed in the listing.
Prices and fees
- All prices must be in New Zealand dollars (NZD) and include all applicable GST (if any).
- Listings fees and success fees (if applicable) are to be paid by the seller. Fees may not be added to the winning bid amount.
Correct vehicle details
You must provide one of the following for the specific vehicle you're selling:
- VIN
- Chassis number
- Number plate
Whichever you choose to provide, it must be the correct one for the vehicle you're selling.
Dealer Microsite
There are two types of images on the Dealer Microsite.
- The Hero image (available to all dealers)
- The Display Ads (only available to those who have “Microsite - Ad Free” product)
The Hero image
- Our 'Microsite' product is to help dealers advertise and promote their dealership brand.
- Like listing images, the Microsite Hero image can't be used to promote additional info, offers or messages.
- Examples of information not allowed in this image are:
- Contact details
- Finance offers
- Other special offers
- This info can be displayed in your listing so it isn’t needed in your Hero image.
The Display Ads
- The primary purpose of these is to promote your brand and to remove other advertisers from your Microsite. You cannot resell any display advertising space to any third party.
- The display ads must:
- not contain content that is, in Trade Me's opinion, offensive, predatory, misleading, inaccurate, inappropriate or illegal.
- not mention Trade Me unless agreed to by Trade Me in writing;
- not mention any other third party unless you have that third party’s consent; and
- comply with New Zealand industry standards, including, but not limited to, standards provided by the New Zealand Interactive Advertising Bureau and the Advertising Codes of Practice issued by the Advertising Standards Authority ("ASA").
Special Offers
- Our Special Offer product is designed to help dealers advertise and promote unique and time-sensitive offers on motors listings.
- To make sure buyers have a great experience when browsing and searching your vehicles, we have some rules for you to follow when utilising Special Offers for your listings on Trade Me Motors.
Special Offer policy
- Dealership Branding: Special Offers may not be used to promote a dealership, or provide additional dealership information or messages not unique to the car in the individual listing.
- Contact details: Special Offers must not include any contact details, dealership addresses, website addresses or other contact details. This information is displayed elsewhere in the listing so there's no need to include it in your Special Offers.
- Finance Offers: Offers displayed must meet all requirements set forth by the CCCFA and FAC.
- Quantity: Every vehicle you list may have a Special Offer. However, each listing may only have one special offer at a time.
- URLs: You may not include any URLs or website links in your Special Offer description. Please paste the link in the required field when setting up your special offers.
Special Offer images policy
- Size: You may use an image to accompany your special offer. Images should be sized at a minimum of 609 px x 456 px and be a ratio of 4:3 to ensure they display correctly and look great on-site. Images that do not meet this size requirement will not be uploaded.
- Promotion: This image must be used to promote the specific special offer rather than for the dealership itself.
- Finance: Finance offers displayed must meet all requirements set forth by the CCCFA.
- Contact details: Images must not include any contact details, dealership addresses, website addresses or other contact details.
Any breach of these policies may result in the adjusting, editing, or removal of your listing, or listings. Continued breaches can result in the removal of all of your listings, or your access to Dealerbase.
Franchise packages
Vehicle condition and vehicle status policy
Dealers on a Franchise package must abide by the following policies when listing their Brand New, Certified Used and Ex-Demo vehicles. Please note – this is for Franchise Dealers only, those are dealers on a Franchise Starter, Franchise Gold or Franchise Platinum package.
- Clean car details must be correct and provided. You acknowledge that it is your responsibility to ensure that accurate Clean Car information is being displayed on your listing and that it relates to the vehicle being advertised.
- No stock images are to be displayed, you must only display images of the vehicle being sold.
- The vehicle must be unregistered.
- The vehicle odometer must read less than 100km.
- In the case that the status is changed, this is only able to be done once. For example, from status 'Brand New, in transit' to 'Brand New, in stock'
- You are only able to list vehicles that you have a franchise agreement to sell. For example, if you have a franchise agreement to sell brand new Mazdas and Audis, you are not able to list a brand new Skoda if you somehow acquired one.
- Clean car details must be correct and provided. You acknowledge that it is your responsibility to ensure that accurate Clean Car information is being displayed on your listing and that it relates to the vehicle being advertised.
- Stock images may be displayed, as long as permission from the rights holder is given.
The vehicle odometer must read less than 100km. - In the case that the status is changed, this is only able to be done once. For example, from status 'Brand New in transit' to 'Brand New in stock'.
- The vehicle must be unregistered and has not been registered by the dealership or any other person in any country.
- The vehicle has been ordered by the dealership, has left the manufacturer's warehouse/factory and is on the way to the dealership/dealership's warehouse. The vehicle can be in customs in its native country, on a container ship, in customs in New Zealand, in New Zealand and on its way to the dealership/dealership's warehouse, or anywhere between those.
- If the vehicle within the listing becomes in stock, the status must be changed to in stock.
You are only able to list vehicles that you have a franchise agreement to sell. For example, if you have a franchise agreement to sell brand new Mazdas and Audis, you are not able to list a brand new Skoda if you somehow acquired one.
- Clean car details must be correct and provided. You acknowledge that it is your responsibility to ensure that accurate Clean Car information is being displayed on your listing and that it relates to the vehicle being advertised.
- Stock images may be displayed, as long as permission from the rights holder is given.
- The vehicle odometer must read less than 100km.
- The vehicle must not have been manufactured or driven and must not have been shipped to New Zealand yet.
- You must have express authorization from the manufacturer.
- You must be clear in your listing that the vehicle is available to order only.
- You are only able to list vehicles that you have a franchise agreement to sell. For example, if you have a franchise agreement to sell brand new Mazdas and Audis, you are not able to list a brand new Skoda if you somehow acquired one.
- A deposit is required, and no obsolete vehicles.
- Only one listing is to display per Model and Fuel type. For example, if you are listing a model and have both 'Hybrid' and 'Petrol' fuel types, you may list two separate listings.
The vehicle can be:
- Manufactured/built and is ready to be shipped from the manufacturer.
- To be built – this must be advised on the listing.
- Clean car details must be correct and provided. You acknowledge that it is your responsibility to ensure that accurate Clean Car information is being displayed on your listing and that it relates to the vehicle being advertised.
- No stock images are to be displayed, you must only display images of the vehicle being sold.
- The vehicle must be currently registered with number plates.
- The vehicle must be for sale, not only available for test drives.
- The vehicle must only have been registered to the dealer and no other entity, in any other country.
- The odometer must read less than 10,000km
- You are only able to list vehicles that you have a franchise agreement to sell. For example, if you have a franchise agreement to sell brand new Mazdas and Audis, you are not able to list a brand new Skoda if you somehow acquired one.
The vehicle is part of a manufacturer-endorsed program where the vehicle has obtained a warranty/level of reconditioning above a standard used vehicle.
The vehicle must be part of one of the following programs
- Toyota Signature Class.
- Toyota Certified.
- Land Rover Approved.
- Jaguar Approved.
- Audi Approved Plus.
- BMW Premium Selection.
- Porsche Approved.
- Mercedes Benz Certified Pre-Owned.
- Certified by Bentley.
- Honda Approved Used.
This is subject to change, if you think your manufacturer has an additional program to add, please have your manufacturer provide the certified program to Trade Me for a compliance review.
DealerBase terms and conditions
- These Vehicle Trader terms and conditions (Terms) govern your use of Trade Me's services; of DealerBase; of the services described in these terms which are generally delivered through DealerBase, via a third party inventory management system, and / or the Trade Me Motors site at www.trademe.co.nz/motors and its associated apps; AutoGrab services, when included in your Trade Me Motors package; and any other relevant services we offer to you from time to time (the Services).
- These Services are provided to you by Trade Me Limited (Trade Me, us, we etc) to registered motor vehicle traders (each a Dealer or you).
- The Services offered to you under these Terms may include products and services of AutoGrab (which is operated by Auto Grab Limited, a subsidiary of Trade Me Limited). Where applicable, references in this Agreement to 'Trade Me', 'we' or 'us' include references to AutoGrab and Auto Grab Limited. You agree that, for the purposes of the Contracts and Commercial Law Act 2017, your obligations under these Terms are also enforceable by Auto Grab Limited. You agree that your agreement is with Trade Me and that you only have a claim against Trade Me in connection with the Services.
- By using the Services you agree to comply with these Terms as well as Trade Me's general terms and policies, including our Motors Listing Policy. To the extent that there is any conflict between these Terms and any other Trade Me terms or policies these Terms will prevail.
- We may change these Terms from time to time by updating the Terms on our website. For significant changes we may notify you directly via email. Occasionally urgent changes may be required, but we'll generally give you at least two weeks' notice of any material changes to give you an opportunity to review the changes before they go into effect. Once any updated Terms are in effect, you'll be bound by them if you continue to use our Services. If you don't agree to any updated Terms, you must stop using our Services.
We encourage you to view this page from time to time for the latest Terms.
- In order to access the Services, you must be a registered motor vehicle trader and always maintain your RMVT status. You authorise Trade Me to search the register of motor vehicle traders to check your RMVT status from time to time.
- If you operate more than one dealership location (being the physical location where your vehicles are located for viewing) you will need to have one account (and therefore one dealer package) for each location. Similarly, you will need to have one account (and therefore one dealer package) for each dealership brand or logo that you wish to use, as we are unable to apply different logos or branding to listings from the same dealership account.
- You confirm that you either own or have permission to use all of the content that you upload to our site or otherwise make available via our platform when using our Services, and that you (and Trade Me) will not infringe the rights of any third party by making that content available. You agree to indemnify Trade Me from any liability whatsoever arising from your use of the Services to display content.
- You acknowledge the exclusion of liability and the indemnity contained in Trade Me's general terms and agree that these apply to the Services and are incorporated into these Terms.
- To access listing data in Dealerbase via our API, you will need to be approved. Approval is at our discretion and will be subject to you only accessing your own listings, and only using this data for reasons agreed with us in writing. You will also be subject to the Dealerbase Listing Data API terms, which you can find further down this page.
- In the event you use any Services that have their own specific terms (for example, Services like Dealer Analytics, Autograb, Sitelink or Dealership Finance Tool which are covered in these Terms), you agree that those specific terms apply and that you will comply with those specific terms.
- If you breach these Terms (or any of our other terms or policies), we may take action and you will need to accept how we proceed. We may, for example, remove or edit your listings, remove your ability to automatically upload listings, or suspend or terminate your access to Dealerbase, the Services, and / or Trade Me.
- The fees payable by you for each Service (the Fees) are the Fees communicated to you by us from time to time. We will always communicate our Fees to you in advance of you ordering or using a Service. If you are unsure what the current Fees for our Services are, get in touch with your Account Manager or our Dealer Support team.
- We may change our Fees. We'll usually notify you about fee changes, and we'll generally give you 2 weeks' notice. If we introduce a new Service, the Fees for that Service will be effective at the time the new Service is launched.
- We'll invoice you monthly and payment is due and payable on the 20th of the month following the invoice date. If you wish to dispute an invoice you must do so, in writing, within 10 working days of the invoice date. We will consider any issues raised and act in good faith to reach a resolution with you. You will pay any undisputed amount on the due date for payment.
- If payment is not received by the due date, or you're otherwise in debt to us under this agreement or any other, we may take action that we consider appropriate. For example, we may:
(i) suspend or terminate your access to our services;
(ii) adjust your listing in search results (even where you have paid for a premium product);
(iii) remove your ability to automatically upload listings;
(iv) charge interest on outstanding amounts not paid by the due date at a rate that is 2 percentage points greater than our bank's unarranged overdraft interest rate, starting from the due date of the unpaid invoice;
(v) set-off any amount you owe us against any amount that may be due from us to you (under any agreement); or
(vi) pass your account onto a debt collection agency. You agree that any costs incurred in the collection process, including legal fees, can be on-charged to your account. - Where a court or tribunal rules against you in any dispute with any Trade Me user, you agree that we may in our absolute discretion apply any money we receive or have received from you to make reparation to that user or other users.
- You agree that you are responsible for the security of your account, and liable for the price of any Services requested through your account, regardless of who accessed your account to make the request.
- You agree that Trade Me may conduct a credit check on you, and may collect and hold information about you, which may be passed on to a credit reporting agency for the purpose of conducting a credit check.
- If you exceed the number of vehicle listings allowed under your monthly vehicle limit, we may upgrade your vehicle limit.
- Although we may upgrade you at any time once you have exceeded your vehicle limit, we will generally:
(i) Notify you via email that you have exceeded your vehicle limit, reminding you to promptly reduce your stock to within your vehicle limit.
(ii) If you do not reduce your stock to within your vehicle limit, we will send you an email giving you 48 hours to reduce your stock to within your vehicle limit.
(iii) If, after the expiry of the 48 hour notice period, you are still exceeding your vehicle limit then we will upgrade your vehicle limit to accommodate the excess stock on site. - If you are upgraded:
(i) in the month you are upgraded you will be liable for the Fees applicable to the vehicle limit used, for the period used. We will send you a part-month invoice for the additional Fees associated with the upgraded vehicle limit for the number of days of the month you have access to it; and
(ii) you will remain on your upgraded vehicle limit (and will be liable for the applicable Fees) unless you request to be changed to a different vehicle limit in which case the timeframes in clause 5 will apply.
- Trade Me may suspend or cancel your use of any Services immediately by notice to you if you breach any of these Terms.
- We may add or remove features or functions and we may suspend or stop providing a Service altogether. We will endeavour to give you notice in advance if we intend to change or stop providing any Service.
- If you wish to stop using the Services, you may provide notice in writing to us. If you provide notice to us on or before the 15th of a calendar month, then that notice will be effective on the last day of that calendar month. If you provide notice to us after the 15th of the month, then that notice will be effective on the last day of the following calendar month.
- If you wish to downgrade any Package, vehicle listing limit or other subscription Service, and the downgrade is one that we allow, you may provide notice in writing to us at any time, and that notice will be effective from the 1st of the following month. To check what types of downgrades are permitted from time to time, get in touch with your Account Manager or our Dealer Support team.
- If your use of the Services is suspended or cancelled the provisions of these Terms relating to payment, debt collection and any other provisions intended to survive suspension or cancellation will remain in force and you remain liable to pay the Fees for all Services up to the effective date of cancellation or suspension. If you have paid Fees in advance then Trade Me will repay to you any Fees paid in respect of Services due to be delivered after the effective date of cancellation or suspension.
- If you haven't used your account for more than 18 months, your account will be suspended and any unused credit will be forfeited to us.
- If you use our Sitelink product:
(i) you must only use it to link to a relevant external website;
(ii) we reserve the right to reject any website you propose to link to; and
(iii)you must not link to any external website that, at any time, has a greater number of vehicles listed for sale than you currently have listed on Trade Me.
- Dealer Analytics is a Service provided by Trade Me which allows Dealers using DealerBase to access information about the performance of their Trade Me advertisements, and anonymised aggregated information about other sellers of motor vehicles on Trade Me. No personal information about you is made available to other Dealers who use Dealer Analytics.
- If you pay for access to Dealer Analytics, Trade Me grants you a limited, revocable, non-transferable, non-exclusive, non-sublicensable, New Zealand-only licence to use Dealer Analytics for the purpose of understanding the performance of your inventory and business advertising on Trade Me. The parts of Dealer Analytics you are allowed to access under this licence depend on the type of Dealer Analytics product you purchase or which you are entitled to access (for example, under a free trial). Your Dealer Analytics licence expires upon the cancellation or suspension of your access to Dealer Analytics, DealerBase or Trade Me.
- If Trade Me grants you access to Dealer Analytics as part of a free trial, you agree that this clause applies with any necessary modification and that Trade Me may suspend or cancel your access to Dealer Analytics at any time.
- You acknowledge that Dealer Analytics is generated with the assistance of Microsoft's Power BI analytics software via DealerBase. Accordingly, you agree that (to the extent applicable) Trade Me may immediately suspend or cancel your access to Dealer Analytics if Trade Me becomes unable to provide Dealer Analytics via Microsoft's Power BI analytics software (but, in such case, Trade Me will endeavour to provide advance notice to you), or if Trade Me reasonably believes that you have:
(i) breached these Terms (including Trade Me's general terms or policies);
(ii) accessed, or attempted to obtain access to, another Dealer's information held in Dealer Analytics without permission;
(iii) attempted to re-identify any aggregated anonymised information available to you in Dealer Analytics;
(iv) introduced, or attempted to introduce, any malicious software or code or otherwise have done anything that could interrupt or disrupt Trade Me's systems; or
(v) committed fraud or otherwise acted unlawfully in connection with DealerBase. - If you are entitled to use Dealer Analytics, Trade Me will use its reasonable endeavours to ensure the availability of Dealer Analytics, subject to any downtime required for maintenance. However, Trade Me takes no responsibility for any unavailability or interruption of your access to Dealer Analytics, or for any loss you incur as a result.
- The information provided to you through Dealer Analytics is updated each working day. Although Trade Me will make reasonable endeavours to ensure the accuracy of this information, to the extent permitted by law, Trade Me does not warrant that the information provided to you through Data Analytics will always be accurate, error-free or up to date.
- You agree that it is your responsibility that any offers for finance that you advertise on Trade Me comply with the Credit Contracts and Consumer Finance Act 2003 and the Fair Trading Act 1986, including ensuring that any third party finance provider that you link to via the Dealership Finance Tool (Finance Provider) is fully compliant. Finance offers and your use of the Dealership Finance Tool are not pre-screened for content by Trade Me.
- You agree that you will not use the Dealership Finance Tool in a way which misleads, deceives or confuses users, or is likely to mislead, deceive or confuse users.
- You agree that any information received about a user through the Dealership Finance tool (whether received by you or by any Finance Provider) will only be used by you or the Finance Provider for the purpose of furthering the user's finance application and that you will not collect a user's personal information for any other purpose or use it for subsequent promotion without receiving specific consent from that user.
- The Drive Chat live chat service is owned, operated and provided by Drive Chat and integrated on to the Trade Me Motors platform (the Live Chat Service).
- In order to use the Live Chat Service, you will need to complete an online application with Drive Chat and select the type of service and package that you wish to use. By using the Live Chat Service on your vehicle listings, you are agreeing to be bound by Drive Chat's terms of service (as may be amended from time to time) in addition to these Terms. Trade Me is not responsible for notifying you of any changes to Drive Chat's terms of service.
- You agree that any information received about a user through the Live Chat Service will only be used by you for the purpose of responding to and assisting with that user's enquiry, and that you will not collect a user's personal information for any other purpose or use it for subsequent promotion without obtaining specific consent from that user.
- You acknowledge that Trade Me will receive transcripts of all chats that occur through the Live Chat Service on the Trade Me Motors platform only, including where those chats are self managed (meaning where they are between you or your representative and a user). You acknowledge that the availability of the Live Chat Service is dependent entirely on Drive Chat. Trade Me takes no responsibility for any unavailability or interruption of access to the Live Chat Services, or for any loss that is incurred as a result. Trade Me may cease providing the Live Chat Service at any time, and / or may suspend or cancel your access to the Live Chat Service at any time.
- You acknowledge that the availability of the Live Chat Service is dependent entirely on Drive Chat. Trade Me takes no responsibility for any unavailability or interruption of access to the Live Chat Services, or for any loss that is incurred as a result. Trade Me may cease providing the Live Chat Service at any time, and / or may suspend or cancel your access to the Live Chat Service at any time.
- Trade Me has no control over and is not responsible for the content posted by you, Drive Chat or any user in any live chat box.
- If you are using the Services only to list and advertise boats for sale then some of the Terms may not apply to you (for example, the requirement to maintain your RMVT status). It should be common sense which Terms don't apply, but if you are unsure please contact us to check, as ultimately we will determine at our discretion which Terms apply to your use.
- If you are a 'Boat Broker' (meaning you advertise boats for sale that you do not own but that you have been engaged to sell) then you may include up to 2 sets of contact details in your listing description (notwithstanding that there are other terms which expressly prohibit this). For the avoidance of any doubt, these specific Boat Broker terms only apply to boats you list in your capacity as a Boat Broker. If you also advertise boats that you own on Trade Me, these specific Boat Broker terms will not apply to those listings.
- Where the Services include access to the AutoGrab products and services, these will be accessed through the AutoGrab platform and you will have an account set up within the AutoGrab platform for this purpose. You can manage access to the AutoGrab platform through that account, and are responsible for all use of the AutoGrab platform that occurs through your account. Your AutoGrab account is for the dealership location that has purchased the applicable Trade Me Motors package that includes the AutoGrab products and services, and may only be used for the benefit of that dealership location.
- You are not authorised or permitted to sell or grant additional licences, sub licences or any other access to the AutoGrab platform or use or otherwise disclose data or other information received through the AutoGrab platform to third parties for any purpose (other than to provide quoted prices to customers).
- The AutoGrab terms of use, available here, apply to the use of the AutoGrab products and services in addition to these Terms.
- Trade Me and AutoGrab in no way guarantee the accuracy of data provided in connection with the AutoGrab products and services and, without limiting the foregoing, make no representations that any prices for vehicles quoted on the AutoGrab platform will be the actual prices for which those vehicles are sold.
1. API Availability and Support
The Dealerbase Listing Data API (the API), and all Data provided through the API, is provided "as is" without any representations or warranties, and without any service levels. While we strive to maintain the availability and functionality of the API, we do not guarantee continuous, uninterrupted access or that any issues will be resolved within any set timeframe.
We may update, modify, or discontinue the API, remove Data, and/or introduce policies that apply to the use of the API or the Data, at any time, with or without notice.
2. Approval of API Use
You must obtain prior written approval from Trade Me for each specific use case of this API and the Data. Please clearly describe how you intend to use the Data in your application, including identifying all third parties that will have access to the Data and all sites the Data may appear on. Trade Me may approve or decline any use case in its sole discretion.
If you fail to disclose any intended use or use the API or the Data for an unapproved purpose, your access to the API and Data may be suspended or terminated.
3. Conditions of access
Access to this API is exclusively for motor vehicle dealers who are users of Dealerbase.
The API only provides access to your listings that are currently live on Trade Me. You cannot retrieve Data for expired or inactive listings.
When using our API you must follow security best practice, and be familiar with and take all reasonable steps to mitigate internet security risks. If we determine that your application or technologies, or any applications or technology connected to our systems through the API, are insecure or may pose a security risk we may, at our sole discretion, disable your access to the API and the Data with or without prior warning to you.
You must not share your access key with any third party, unless the third party is named in your application form and approved by Trade Me. You are responsible for the security and confidentiality of your access key. You are responsible for the use of the API and/or the Data by any person using your API key.
Where Trade Me displays legal or consumer notices to Users you must display those same notices to Users at the same stage of the transaction process.
You and your use of the API and any Data must comply with all applicable law.
You must ensure that any data you or any third party using your API ket submits to Trade Me is accurate and that you or the third party have the right to send it to us and for us to use it.
5. Data Ownership and Usage
All listing data retrieved through the API remains the property of Trade Me and/or the person who uploaded that data to Trade Me. You are granted a limited, non-exclusive licence to use this data solely for uses identified in your application.
You may not sell, distribute, or share the listing data obtained from the API with any third party except to the extent set out in your application and approved by Trade Me.
You must take all reasonable steps to keep Data secure from unauthorised use or access.
6. Termination
Trade Me reserves the right to suspend or terminate your access to the API at any time, with or without cause. Reasons for suspension or termination may include, but are not limited to, potential threats to the security of Trade Me’s systems, breach of these terms, misuse of the API, or any activity that may negatively impact Trade Me or its users.
7. Changes to Terms
Trade Me may update these terms and conditions at any time. We will give notice of any changes to current uses of the API.
8. General
We give no warranties about our API or the Data.
To the maximum extent permitted by law, all liability of Trade Me to you or any other person under these terms, or in connection with the API or any Data, is excluded regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise.
No failure by us to enforce any provision of these terms, or forbearance granted to any person using the API does not operate as a waiver.
To the extent that Trade Me’s liability cannot be excluded it is limited to $100.00.
You agree to release, indemnify and keep Trade Me indemnified from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by us to any person arising out of or in connection with your failure to comply with these terms, or the use of the API or the Data by you or any person using your API key.
These terms are governed by the laws of New Zealand. You submit to the exclusive jurisdiction of the Courts of New Zealand.
