1.1 If you would like to operate a Trade Me store, you must ask for our approval first. You can ask to set up a Trade Me store by emailing email@example.com. We may decline to allow you access to a Trade Me store at our sole discretion, but we will usually allow you to operate a Trade Me store unless your existing trading history suggests a failure to comply with law or our standard terms and conditions or code of conduct, or other inappropriate behaviour.
2. Management of your Trade Me store
2.1 You must nominate a person (or people) with the authority to operate your Trade Me store. Trade Me will accept instructions only from authorised people. The people you nominate must have authority to make decisions on customer complaints.
2.2 You must maintain a consistent product range, in terms of the type, quality and number of products listed. Any significant variation of product range must be approved by Trade Me.
2.3 You must maintain a high standard of customer service, respond promptly to customer enquiries, have a consistent and effective complaints handling process, and resolve customer complaints in a timely and fair manner.
2.4 You must comply with all relevant Trade Me policies including complying at all times with Trade Me's terms and conditions.
2.5 You must comply with all applicable laws, including the Consumer Guarantees Act 1993, Fair Trading Act 1986, Sale of Goods Act 1994 and the Contractual Remedies Act 1979, as well as any applicable product safety standards.
2.6 You will ensure discounted pricing and clearance labelling on your listings is used responsibly and is not likely to mislead or deceive others. You will comply with our policy for promoting discounted items on Trade Me. We may limit your access to the 'was/now' pricing function if we have concerns about your use of discounted pricing, or if you are in breach of these terms and conditions.
2.7 While you operate (or are eligible to operate) a Trade Me store you will disclose to buyers that you are acting 'in trade'. You acknowledge that you have read and understand Trade Me's help page regarding 'in trade' disclosure.
3.1 You must pay the following fees, plus applicable GST:
Standard stores setup fee: $399.00 payable prior to launch of your Trade Me store.
Monthly fee: $79 payable monthly in advance from your Trade Me account.
3.2 You must ensure your Trade Me account has sufficient credit in it to pay the fees when they are due.
4.1 Trade Me will provide you with specifications for images for your Trade Me store and you must provide suitable images. Trade Me may update image specifications from time to time and you must update your Trade Me store images to meet the new specifications.
4.2 You may provide your phone number (or email address if you are an approved overseas seller operating a Store) and physical address on your Trade Me store page, but must not include these details in your listings or branding.
4.3 You may link to your own website from your Trade Me store page, provided your website does not include any shopping cart or e-commerce facility. You must not link to any third party website. You must demonstrate a commitment to selling through Trade Me and not incentivise or solicit customers to transact with you outside Trade Me.
4.4 Trade Me can remove or decline to display content in your Trade Me store if we believe it is likely to negatively affect Trade Me's website or brand or other users' experience of Trade Me.
4.5 You must not drop-ship or use any other type of on-behalf shipping arrangement, or operate multiple memberships or multiple Trade Me stores, without Trade Me's approval in writing. Trade Me has the discretion to grant or withhold this approval. More information about becoming an approved On-Behalf Shipping approved seller is on our 'Drop shipping' page.
4.6 Trade Me reserves the right to set conditions on the operation of your Trade Me store. Trade Me will notify you of such conditions (Special Conditions) in writing and you agree to comply with these.
4.7 Trade Me stores, like Trade Me accounts, are not transferable.
5. Closure or suspension
5.1 You may close your Trade Me store at your discretion by giving Trade Me notice in writing. Your Trade Me store will close at the end of the billing period in which Trade Me receives such notice from you, or on a date mutually agreed.
5.2 Trade Me may suspend your Trade Me store if you breach these terms and conditions. Trade Me will notify you of any suspension, the nature of the breach, and steps you must take to have your Trade Me store reinstated. Once you have remedied the breach to Trade Me's satisfaction Trade Me will reinstate your Trade Me store. You will not be entitled to any reduction of fees during the period of your Trade Me store's suspension.
5.3 Trade Me may terminate your Trade Me store at its discretion by notifying you in writing. Your Trade Me store will close at the end of the billing period in which Trade Me sends you such notice, or on a date mutually agreed.
5.4 In case of any suspension or termination of your Trade Me store you agree complete any trades with Trade Me users in a timely and fair manner.
