What if the buyer pays after you have relisted an item?
Say I wait three business days after a sale and do not get a response.
I figure it's 'one of those kinda buyers' and inform them that I am applying for a Success Fee return, retracting the sale from them and relisting.
A few days after relisting the previous buyer notices the item selling for more and feels they are still entitled so go and quietly pay expecting me to drop current auction and release to them?
Unless an obnoxious bank fee I can see myself returning payment to sender and blocking future transactions but if a hardened troll they could use other means to conitnue making the payment again.

You can't return an unsolicited payment.
So I guess just extra cash for me.

The best thing is to stick to the process. Apply for your refund and then Trademe gives the buyer 3 days to make payment or they refund you the success fee. Wait till you have the success fee refund before relisting and there is never any doubt to you or Trademe that the buyer is not going to pay. If you relist before getting the refund, that oipens up the chance the buyer can then turn around and say you had no intention of honoring the sale in the first place. Trademe do recommend to wait 3 days after the sale for contact and 7 days for completion, but stuff happens and people get distracted.

My concern was more someone claiming legal enitltement to some form of compensation because of a rogue payment to my bank account which I ignored.

She couldn't refund the rogue sender.
Using some common knowledge however my goods sell for under a hundred dollars so I can't see any obligations especially with a trail demonstrating that the rogue payment was with intention to manipulate or harrass.

Pretty sure any buyers legal entitlement to the item ends at the time the success fee has been refunded to you, as the refund being issued means the buyer has either replied to Trademe to state they will not be completing, or have not replied to Trademe to confirm either way, within the 3 day time period since you applied. Trademe used to place a blue Trademe note on members feedback page to signify this happened so everyone knew, but they don't do that anymore.
As far as compensation goes, that sounds a bit silly of a buyer to suggest. Most people would not pay if they didn't think the item was going to be supplied, especially if there was no contact made either way. If someone has made an untraceable payment to someone else, then that's on them and pretty foolhardy.

As Gary mentioned, TradeMe allow the Buyer 2 days to make contact and 1 week to make payment completing the Trade. - If your Buyer paid within that week albeit passed the 2 days they are still within the allowable payment timeframe. - TradeMe do not look into a Success fee refund until day 8 unless they have evidence you and the Buyer have come to an agreement to cancel the Trade, outside of such agreement they then allow the Buyer a further 3 days to respond by notification to TradeMe of their intent to pay, following by payment made, or of their intent not to follow through with their purchase. - If you've moved before the initial week ended your Buyer could have just cause to raise a Dispute - They may not have seen your relisted item as life does get in the way of TradeMe at times but rather followed their initial payment intent therefore benefit of doubt comes into play.
As Gary advised it's best not to relist items until you have your Success fee refund from TradeMe and you have refunded the Buyer their payment. - The case in the Link you posted was refunded by TradeMe supplying the relevant Bank account. - Legally you cannot keep funds paid, these are handed to the local courts who retain the funds in a holding account awaiting the Buyer to claim. - Cheers.
