What do I do if a seller wants to back out of a trade?
Won a auction that was listed as Quick sale buy now for $1.00. Won it and was contacted by the seller saying they made a mistake and won't be letting me have the item. Have asked them how did they get it so wrong with all of the steps needed to make the auction "live". Can't made a report yet as item not appearing in my list.

Oh. You only won it yesterday? Perhaps you are being a bit impatient here Sue?
I'd give the seller some time to read and respond to your email before you get too concerned. Especially as it looks like they are very apologetic and busy......

This mistake can easily be done,
he may have only wanted the $1 reserve but not $1 buy now and wanted let it to run a week,
hoping for a few more dollars, letting the market decide the final price, knowing they would get more than $1,
but at end of week it would be sold, hence a quick sale, sold in a week,
even in my products, when duplicating a sold auction, you change all the item product details, but forget to go down and change
the reserve and remove the buy nows, and even forget to change the shipping too, hit activate and save where it will go live without realizing your mistake,
think many of us have done that at times, on more than one occasion, mistakes happen, we are all human,
in this case I think the $1 Buy Now may have been a genuine mistake,
I remember hitting a buy now once knowing it would have been a genuine mistake and alerting the Seller, so she could relist quickly, and not have issues with a buyer, she was so grateful for my honesty,
it was an item I would have brought too, so if it was not a mistake, would have been a bargain,

Hi Bill. As Flossy63 says mistakes like this are easy to make and can indeed be genuine. I've done it myself once when I sent out a $5 Fixed Price Offer (Should have been $500.) The seller is actually covered by law for such things and legally doesn't have to complete the trade. Maybe work with the seller and come to a mutual price. Word it nicely and they might give you a discount of some kind so you are both happy :)

Providing the seller gives a 100% refund, I see no reason why they cannot back out of a sale. I have done this, for the same reason as Callum, however in my case the buyer got very abusive, threatening me with the police etc. My mistake was also very obvious, a $950 item offered for $9.50

Won the trade, paid the price, noe Seller has advised he can't deliver goods as agreed. Has is stalling over sending a refund. This is fraud if advertising and accepting payment then not delivering the goods. Where can i get enforcement for them to refund the purchase price

Hello Sue. That sounds strange. What reason is the seller giving you for not sending the refund?
If you haven't already done so go to your won page and hit "Dispute Resolution" on the right.

Apart form advising they cannt deliver (parts missing) and promising to refund we have heard nothing more. We have sent a number of emails requesting urgent action on the refund - he has our bank account details

Hello again Sue. How long ago did you win the item? If it has been longer than 45 days you won't be able to open a dispute, but you can still contact Trade Me via Live Chat to explain what has happened. They will be able to contact the seller to give them a nudge.
Picture below to show where Disputes Resolution appears. It is on your won page, at this link

Kia Ora Sue,
All Trades have an initial processing time of 3 days before they appear for a Dispute resolution - As Callum has advised, only winning yesterday you need to give your Seller time - It sounds like TradeMe may not be their main business therefore they may be at work still today - TradeMe allow Sellers a couple of days to make contact and the Trade to be completed within a week - they have made contact and been very honest about losing parts and requested your Bank account to make the refund into so they do have good intent therefore sit tight for a couple of days - if you hear nothing by Thursday 16 May 2024 go ahead and fill out the dispute resolution form which will have become available for you to process However TradeMe staff will Not look into your concerns until day 8 of the Listing closing, giving your Seller their due course to resolve within 1 week & I'm sure your Seller will have followed through by then given their upfront honesty. - Cheers.

A little patience required on the buyers part by the looks. These things happen.

flossy63 Community SuperuserYou need to patient, we don't all live online 24/7,he may even be having another search to make sure it cannot be found before refunding, double checking,as I have mis placed items I have sold too, initial search cannot locate, so before I advise my buyer when packing combined items, I have a break do someone else's order, and I then go back later with fresh eyes to look, or after I have slept on it, look again in morning and sure enough I was looking too hard, move an item and there it is in front of me where I had looked and where it should have been,Your seller is probably doing the same before hastily refunding, It has only been 1 day,And in this situation seller was honest with you, kept you informed straight away, so no bad feedback should be placed,it happens,I recently sold an item & could not find it, then realized it may have accidentally gone to op shop with other stuff, buyer was very understanding,0

Your Seller has kindly let you know they will be able to look for this missing part in the coming weekend and will relist the item if found...
<quote> I will relist when I find but won’t be for some time until the weekend until I can look again. </unquote>
If you Really want the item what is the harm in letting your Seller get back to you in the weekend when they have had the chance to look for the missing piece? - Most Buyers would be happy to wait considering your Seller has been upfront from the start and already requested your Bank account details to process a refund. - Cheers.

Trade Me Listing: P233846726 -- Hawk Handheld tyre inflator. Won the auction at 12.30pm yesterday. The following email recived at 1.43pm yesterday. Nothing since!
Hi there, I’m very sorry I have spent most of the day searching for the air hose to this as it has been misplaced. I am selling so much stuff that it must have slipped out of the box when I last listed and checked it.
I have received your payment. Can I please have your bank details to refund this. Very sorry again. I will relist when I find but won’t be for some time until the weekend until I can look again.

Yeah, he got our money quickly and in good faith yesterday. He responded quickly yesterday but nothing since. Not a lengthy process to do online banking. More the fact they are ignoring our correspondence. We are busy as well and still paid the for purchase promptly.
