Vehicle sold with Buy Now as other person was on way to view - what do I do?
AnsweredThis morning I received the first call for my house bus listed on Trade Me. The lady was very keen. They were travelling up from Auckland to Whangarei to view tonight. She asked me to give them priority as they had missed out on other buses. I agreed. Then at 1.20pm I received an email from Trade Me stating the house bus had sold through "Buy Now" to another purchaser unseen before I had chance to put a note on the listing of the viewing later today. So I have an upset lady contacting me assuring me that the bus has been sold to her pending viewing. Who takes priority. The travelers or the unknown buy now person?

IMHO, of course the priority goes to whoever hit "buy now" first. There's no reason to "hold" for someone who's on the way to view, what if they change their minds? Or they found the bus not suitable?
If you were serious about giving them the priority, you should have withdrawn the listing. As long as the listing is still live, you can't stop anyone from hitting "buy now".

Agree. The "buynow" buyer. Legally they have the contract. It might depend somewhat on exactly what wording was used with the first person, but to me that sounds like a viewing rather than a sale.
Don't write off the first lady though. Occasionally people will hit buynow then turn up and try negotiate a lower price or find problems with the item. Make sure you don't fall for that. It might appease the first lady at least if you mention that it's possible the buynow person could still back out though.

If you are an "in-trade" seller you would have some obligations to sort it out.
I am guessing you are just a casual seller selling a second hand fridge? In that case it comes down to your own moral compass really. Legally there is no obligation on you to refund them. You have no idea how they have treated the fridge in their ownership. Even transporting fridges can cause issues if it hasn't been done correctly.
But you might want to consider what you would like or expect to be done if it was the other way around. If you had bought the fridge from them and it failed would you expect them to do anything? If you are feeling bad about it perhaps there is some middle ground. Such as paying or part paying for a part that is needed to fix the fridge. Certainly a full refund is way too far in my view.

I just purchased a black jeep from trade me for 26000 4 days ago. on the first night i found out the headlights were faulty and made clear the car wasn't up to warrant of fitness standard.
They said it had never happened before. Before i dropped the car i asked for them to run it through a vtnz to make sure the after market led headlights would pass a warrent coming up. they said no as it has never had a problem in past.When i dropped to jeep off to them to fix they then said , only owned the jeep for 2 months and had never run it through for a warrent???.
They still have the jeep in there possession with it in my name and my insurance. 2 days ago i said i need it run through vtnz to be passed with led head lights After asking yesterday what are they doing, they haven't replied and im getting worried and loosing trust in them . what do i do???.0 -

shanan 2 days isn't really too much concern if they have to source and refit factory headlights. Although they should let you know what is happening I agree.
For the important question, was this a dealer sale or a private?
