Kim, If the fault is not something you can live with or negotiate a discount for, you ask the person why they bothered to list it if it was faulty and if no legitimate reason is given, place feedback to voice your displeasure, buy elsewhere. Could be that the actual owner has decided not to sell it now, which is one of the problems of selling something that you don't actually have. Perhaps the seller can put you in touch with the owner to negotiate something, rather than going through a middleman.

Sorry to hear that Trade's fallen through,
If you've paid for the item your Seller has to ensure you are refunded immediately regardless if they were selling on behalf of someone else, they sold via their TradeMe account so it is their responsibility to ensure you are refunded and their responsibility to recoup any money which may have been paid direct to the person they sold it on behalf of.
If you haven't paid for the item(s) just leave appropriate feedback which should have a friendly face due to your Seller acknowledging there is a fault prior to sending the goods.
If you run into any problem you will have to file a Dispute Resolution for assistance directly from a TradeMe Staff member. - In this case leave appropriate Feedback though keep it light and to the facts - No defamatory comments.

Hi Kim. If the seller has found the item is faulty and it hasn't been sent yet I would count that as a lucky save. Have you paid?? If you haven't paid, very easy to say ok, a bit disappointed but thanks for letting me know and just move on. If you have paid ask for a refund quickly.
It doesn't make much difference if they are selling for someone else, happens sometimes :) Have a good Christmas.
