Gold Trade Rebate terms and conditions

  1. Background
    1. These Gold Trade Rebate terms (“Terms”) are the terms and conditions on which Trade Me Limited (“Trade Me”) offers the Gold Trade Rebate (“Rebate”) to Trade Me members.
    2. If you qualify as an Eligible Member, and by completing an Eligible Sale, you agree to these Terms. Trade Me may update these Terms at any time without notice to you, but will adhere to the terms that applied at the time you completed an Eligible Sale.
  2. Eligibility
    1. To be eligible to receive the Rebate, (“Eligible Members”) Trade Me sellers must:
      1. have their company or head office located in New Zealand; and,
      2. display the in-trade label on their listings.
    2. Eligible Members may receive the Rebate for transactions (“Eligible Sales”) where they:
      1. have provided free, courier-tracked shipping, and the buyer paid no shipping charges,
      2. are eligible for Buyer Protection; and
      3. used PingPay Now, or Afterpay to make payment.
    3. Whether a Trade Me member qualifies as an Eligible Member with Eligible Sales is at Trade Me’s sole discretion. Trade Me may audit your membership at anytime to determine whether you remain an Eligible Member with Eligible Sales.
    4. To redeem the Rebate for Eligible Sales, Eligible Members must provide Trade Me with the item’s shipping tracking number within two business days of receiving payment for the Eligible Sale, in accordance with Trade Me’s tracking number help page, unless otherwise agreed with Trade Me in writing. For the avoidance of doubt, Eligible Members will not receive the Rebate for Eligible Sales where they have not redeemed the Rebate as described in this clause 2(c).
    5. Trade Me may reverse payments for Rebates paid to Trade Me members where they provided inaccurate or invalid shipping tracking numbers, or did not provide free shipping.
  3. How Rebate is Calculated & Paid
    1. The Rebate is 10% of an Eligible Sales’ success fee, after any other discounts or rebates (such as the Top Seller discount) have been applied.
    2. The Rebate will be automatically paid into Eligible Members’ Trade Me accounts within two business days of the shipping tracking number being provided.
    3. Notwithstanding (b) above, Eligible Members who are invoiced monthly by Trade Me will be credited a Rebate payment as part of the monthly billing process, unless otherwise agreed in writing with Trade Me.
    4. Rebates and fee information is available to Eligible Sellers in the My Trade Me account statement page.
    5. Where a Rebate has been applied to an Eligible Sale, and you successfully apply for a success fee refund, Trade Me will credit the relevant success fee back to your Trade Me account, then debit that account for the Rebate balance.
  4. Suspension
    1. Without limiting any actions which may be taken under the Trade Me terms and conditions, Trade Me may immediately suspend your access to the Rebate (with or without notice to you) if you breach these Terms, or engage in conduct that Trade Me (acting reasonably) deems inappropriate or unacceptable or likely to damage the reputation or goodwill of Trade Me.
  5. Liabilty
    1. To the fullest extent permitted by law, Trade Me shall not be responsible for any loss, damage or injury whatsoever suffered by you in respect of the subject matter of these Terms (including but not limited to any direct, indirect, consequential, special, punitive or incidental loss or damages) and Trade Me’s liability to you will in all circumstances be limited to $50. For the avoidance of doubt, nothing in these Terms is intended to modify or negate a consumer's rights under the Consumer Guarantees Act 1993.
  6. Other terms
    1. Where there is any direct conflict between the Trade Me terms and conditions and these Terms, these Terms shall prevail. For the avoidance of doubt, nothing in these Terms limits Trade Me’s ability to take the actions contemplated by clause 2.6 of the Trade Me terms and conditions as they may apply to the Rebate.
    2. The Ping terms and conditionsPay Now terms and conditionsAfterpay terms for Trade Me sellers, and Buyer Protection Policy (as amended from time to time) apply with all necessary modification to these Terms.
    3. Trade Me will collect and hold your information in accordance with our Privacy policy.
