Key Dates

• Nomination Period - From 12.01am 18 November 2024 to 11.59pm 29 December 2024,
• Finalists announced - Between 6 January 2025 and 17 January 2025
• Voting Period - From the time of the announcement of the Finalists to 11.59 pm 14 February 2025
• Winners announced - Between 17 February 2025 and 14 March 2025

Acceptance of these terms & conditions: The Trade Me Property People’s Choicest awards (People’s Choicest) are run by Trade Me Limited (Trade Me, we, us). By participating in People’s Choicest you agree to be bound by these terms and conditions. If you are selected as a Finalist, and you no longer wish to agree to these terms and conditions, you must let Trade Me know and Trade Me will remove you as a Finalist. 

Changes: We may vary any of the dates, criteria or terms and conditions for People’s Choicest, and we may suspend or terminate People’s Choicest, for any reason by placing a notice of the change on Trade Me’s website www.trademe.co.nz. 

Eligibility criteria: New Zealand residents who are 18 years and over may participate (including entering a nomination and voting). Directors and staff of Trade Me and its related bodies corporate are not eligible to enter a nomination, be the subject of a nomination, vote and/or be selected as a Finalist or award winner. Both self-nomination (as appropriate to the award category) and third-party nominations that comply with these terms and conditions are accepted.

Authorisation: The person entering a nomination is responsible for ensuring that the relevant nominee (i.e. the individual who is the nominee in the Local Legend category or the relevant entity, owner, representative and/or other relevant party (as appropriate) of a nominee for categories other than the Local Legend category), agrees to the nomination, provides all necessary authorisations and consents and is aware of and accepts these terms and conditions for People’s Choicest and Trade Me’s Privacy Policy. 

Eligibility criteria for each People’s Choicest award category:

• Suburb
  This award recognises a suburb in New Zealand that has outstanding qualities. Nominations must include a compelling rationale explaining why the suburb nominated deserves this recognition. The recipient of the award will be the local council or other suitable representative.
• Playground
  This award celebrates the public playground in New Zealand that has exceptional features and community impact. Nominations must include a compelling rationale explaining why the playground nominated deserves this recognition and the precise location of the playground. The recipient of the award will be the local council or other suitable representative.
• Local Legend
  This award recognises an individual in New Zealand who has made a significant impact on their local community. Nominations must include a compelling rationale detailing the nominee’s contributions, highlighting their efforts in fostering community spirit and driving positive change. Nominees must be 18 years and over as of 18 November 2024.
• Dairy
  This award celebrates a diary in New Zealand that stands out. Nominations must include a compelling rationale detailing what makes the dairy deserving of this recognition and the precise location of the dairy. The recipient of the award will be the owner or representative of the dairy.
• Public toilet
  This award recognises public toilets in New Zealand. Nominations must include a compelling rationale detailing what makes the public toilet deserving of this recognition and the precise location of the public toilet. The recipient of the award will be the local council or other suitable representative.
• Bush
  This award honours public bush areas in New Zealand. Nominations must include a compelling rationale detailing what makes the bush area deserving of this recognition. The bush area nominated must be accessible to the public and the precise location of the relevant bush area must be included in the nomination. The recipient of the award will be the local council or other suitable representative.
• Landmark
  This award recognises public landmarks in New Zealand.  Nominations must include a compelling rationale detailing what makes the landmark deserving of this recognition and the precise location of the landmark. The recipient of the award will be the local council or other suitable representative.

Nomination Period: Nominations must be entered during the Nomination Period (defined in Key Dates above).  You will be deemed to have entered at the time we receive your entry. 

How to make a nomination: to enter a nomination either:

(a) complete the award entry form https://www.trademe.co.nz/c/promo/peoples-choicest; or
(b) comment on Trade Me’s social post for the relevant award category via Facebook and Instagram.

Maximum number of nominations: There is no limit on the number of nominations that an individual may enter for each award category and you may nominate the same nominee in the appropriate category more than once. 

Valid nominations only: All required information must be included in the nomination in order for it to be deemed valid. Late, ineligible, incomplete, inappropriate (to be determined in Trade Me’s sole discretion), corrupted, illegible, unlawful, defamatory, irrelevant, infringing, fraudulent, misleading or unauthorised nominations will be deemed invalid and will not be entered.

Further information:   We may ask for additional information for an entry and reserve the right to verify the validity of an entry. If you do not provide requested information, it may compromise the validity of the nomination and therefore the ability for your nominee to be a Finalist or a Winner.

Technical issues: We are not responsible for: (a) any technical malfunction in any communication network or platform; or (b) any nominations being lost, received late, rendered illegible or corrupted.

Warranties: You warrant to us that: (a) you have all necessary rights, consents and authorisations (including from the nominee) to submit each of your entries/nominations and all the content in them (including all personal information, copy, images and branding); (b) you are the owner or licensee of all intellectual property rights in the nomination entry content, including any copyright or trade mark rights contained in that content and it does not infringe any third party’s intellectual property rights; (c) all information that you submit is true, current and complete. If you breach any of these warranties, any affected nomination and entry will be deemed invalid.

Selection of Finalists: There will be up to 3 finalists for each award category (each a Finalist). The Finalists will be selected by Trade Me on the basis of the total number of nominations per nominee from the valid nominations entered for each category. Trade Me’s decision as to the Finalists is final and no correspondence will be entered into. If necessary, Trade Me will contact a Finalist via email. For the Local Legend category, we may also contact the person who nominated the Finalist. We will use the email address provided on the nomination form or, if the nomination was made through Facebook or Instagram, we will make contact through that platform. If a Finalist no longer agrees to these terms and conditions then they will be removed as a Finalist and Trade Me may, if it deems it appropriate, select another nominee as a replacement Finalist. The Finalists will be announced on Trade Me’s Facebook and Instagram account as well as clearly communicated on the nomination page.

Voting for the Winner of each People’s Choicest award: There will be one winner per the People’s Choicest award category (each a Winner). The Winner of each award category will be selected from the Finalists for that category by way of public vote during the Voting Period (defined in Key Dates above).  Anyone can vote during the Voting Period by following the instructions provided in Trade Me’s website leading up to and during the Voting Period. 

Winners: The Winner for each award category will be the Finalist in that category that receives the most number of votes. Trade Me will notify the Winner (or the relevant entity, owner, representative and/or other relevant party (as appropriate)) by email. Trade Me reserves the right to select another winner if an initial Winner does not respond within 72 hours of notification. Trade Me’s decision as to the Winners is final and no correspondence will be entered into.  The Winners will be announced on Trade Me’s Facebook and Instagram account as well as clearly communicated on Trade Me’s website.

The prize - what the Winners receive:

• Suburb - The winner in this category will receive a commemorative plaque or signage.
• Playground - The Winner of this category will receive a commemorative plaque or signage.
• Local legend - The Winner of this category will be awarded a commemorative medal.
• Dairy- The Winner of this category will receive a commemorative plaque or signage.
• Public Toilet - The Winner of this category will receive a commemorative plaque or signage.
• Bush - The Winner of this category will receive a commemorative plaque or signage.
• Landmark - The Winner of this category will receive a commemorative plaque or signage.

All use of Trade Me branding in connection with an award or prize is subject to Trade Me’s approval. 

Trade Me may add a further prize or celebration for the Winner of one or more of the award categories as determined by Trade Me, at its discretion, to be appropriate. 

Substitution of prizes: A Winner cannot change, transfer or assign a prize. Where necessary, we reserve the right to substitute a prize for a prize of similar value. We will notify the relevant Winner if we need to substitute a prize.  

Publicity: Participants agree that if they are selected as a Finalist and if they are selected as a Winner, their name, location, character, photographs, videos, voice, likeness and a description of any prize (if applicable) may be used by Trade Me for advertising, marketing and promotion purposes including being published on Trade Me’s social media, within email marketing and/or on Trade Me’s websites, and any relevant media that becomes of this campaign.  Each Finalist and each Winner further agree to make themselves available for the preparation of all publicity and participate in all promotional activities that Trade Me requires and agree to be photographed and videoed for this purpose and that they are not entitled to any fee or compensation in connection with such publicity.  

Our rights to use your nomination entry content: By submitting a nomination, you grant to us a perpetual, royalty free, world-wide, non-exclusive licence (with a right to sub-license) to use, copy, change, edit, modify, adjust, adapt, exploit, transmit, distribute and publish the content of that nomination in any media for the purpose of promoting the People’s Choicest awards, and/or our goods or services. You warrant that our use of any entry content submitted by you, does not and will not infringe any intellectual property or privacy rights of any third party.

Liability: To the fullest extent permitted by law, Trade Me shall not be responsible for any loss, damage or injury whatsoever suffered by any participant (including a nominator, nominee, Finalist or Winner or any other person) resulting from their participation in the People’s Choicest and/or receipt or use of any prizes (including but not limited to any direct, indirect, consequential, special, punitive or incidental loss or damages). Trade Me’s liability to any person will be limited in any circumstances to a maximum of $100.

Emails and electronic communications: By participating in People’s Choicest you agree and consent to us sending you electronic messages, including emails, related to People’s Choicest. For example, we may send you an email if you are a Finalist and/or a Winner. Emails will have an ‘unsubscribe’ option where required by the Unsolicited Electronic Messages Act 2007.

Privacy: Trade Me will collect, use and hold any personal information provided in connection with People’s Choicest (for example the names and email addresses included in a nomination) for the purposes of conducting The People’s Choicest (including in order to notify you if you are a Finalist and/or Winner), in accordance with our Privacy Policy. 

Terms and conditions and breach: Trade Me’s policies, terms and conditions apply with all necessary modification to the Awards. If you breach these Terms (or any of Trade Me’s other terms and policies), we may (in our absolute discretion) invalidate your participation in The People’s Choicest, including, where relevant, any nomination you have entered.

Facebook/Meta/Instagram/TikTok/YouTube/LinkedIn: The People’s Choicest is solely operated by Trade Me and is in no way sponsored, endorsed or administered by, or associated with, any third party (including any platforms we may use to promote the People’s Choicest, such as Facebook,  Meta, Instagram, TikTok, YouTube or LinkedIn). Participants release  such third parties from any liability associated with People’s Choicest or any prize.
